This Privacy Policy explains how Performance Capability ("we", "us", "our") collects, uses and protects your personal data when you use Cognativ (the "Service"). Cognativ is a platform built on the Cognitive Reflex Recognition® framework.

1. Who we are

Performance Capability is the data controller for personal data processed through Cognativ. For any privacy questions, contact us.

Account data: name, email/username, organisation and billing details.
Content you enter: the descriptions of behaviour, situations and goals you submit to run a diagnostic.
Usage data: how you interact with the Service, device and log information.

To provide, operate and improve the Service.
To generate the diagnostic insights you request.
To manage your account, billing and support.
To communicate with you about the Service.

4. Lawful basis

We process personal data on the bases of performance of a contract, our legitimate interests in operating and improving the Service, your consent where required, and compliance with legal obligations.

5. AI processing

Cognativ uses a third-party large language model as its reasoning engine to generate insights from the content you submit. Content you enter may be transmitted to that provider solely to return your result. We do not use the personal content you submit to train foundation models. You should avoid entering identifying details of third parties where it is not necessary.

6. Sharing

We share personal data only with service providers who help us operate the Service (such as hosting, payment and AI processing partners) under appropriate contractual and security safeguards, and where required by law. We do not sell your personal data.

7. Retention

We keep personal data for as long as your account is active and as needed to provide the Service, then for any period required to meet legal, accounting or reporting obligations.

8. Your rights

Subject to your jurisdiction, you may have rights to access, correct, delete, restrict or object to processing of your personal data, and to data portability. To exercise these, contact us.
